MINUTES – JUNE 6, 2007 – ANC3D

 

 

The regularly scheduled monthly meeting of ANC3D was called to order on June 6, 2007 at 7 pm by chair Rachel Thompson.  All Commissioners were present except Commissioner Haas who arrived shortly thereafter.

 

Applications Considered

 

1.  George Washington University Mount Vernon Campus – Pelham Replacement Project [Special Exception Application for Amendment to and Further Processing of an Approved Campus Plan] Zoning Commission Case No. 07-12

Alicia O’Neill discussed the Pelham Replacement Project which will be presented to the BZA on July 2nd.  The application is in two parts: replacing Pelham Hall and the secondary access road.

 

Three issues were discussed: updated design; storm water management and traffic control.

 

After much discussion, Commissioner Heuer motioned to support GW's application with the following conditions:

 

1.  Because 22,000 square feet of allowed building area is being taken from the NW portion of the campus and added to Pelham Hall, GW agrees to not seek to reinstate the 22,000 square feet until the 2011 campus plan at the earliest.

2.  GW will work to complete a storm water management plan for entire campus

3.  GW will complete a campus environmental plan that extends to its impact as far away as Hutchins Place.

4.  GW will implement a landscape buffer in the protected area along W Street.

5.  GW will use its best efforts to reach agreement with W Street neighbors on issues they raise


If agreement is not reached with W Street neighbors, there will be a contested BZA hearing.

 

Commissioner Wells seconded the motion which passed 6-1-0 with Commissioner Haas opposing.  Commissioner Gates will testify for the Commission at the GW hearing.

 

2.  Application to install driveway at 3200 44th Street NW

 

This application was to improve a driveway apron and pave the existing gravel driveway.  Commissioner Sandza motioned for approval, seconded by Commissioner Gates.  Vote: 7-0-0 

 

3.      Application to install new driveway cut at 3045 Chain Bridge Road.

 

Commissioner Sandza moved for approval.  Commissioner Smith seconded the motion.  The motion was defeated and therefore the application denied.  Vote: 3-4-0.

Commissioners Haas, Heuer, Gates and Thompson opposed.

 

4.  4818 Foxhall Crescents NW.  – Request for minor modification of approved plans, BZA order  #15340.

 

Attorney Patrick Brown stated that his client, a developer, purchased this property in 2004 and wants to build a single family home. He stated that he seeks the right to build pursuant to a minor modification because that requires the new house to be consistent with the surrounding homes.

Minor modifications can be allowed up to 6 months after an approval order is issued if :

 

1.  Applicant shows good cause;

2.  The proposed modification does not present a material change

 

The order the applicant is seeking to modify was approved in 1991.

 

Several neighbors appeared and voiced their opposition to the modification, stating that they want the applicant to be required to go through the entire normal process of getting a building permit so that they can be heard and protected.

 

Commissioner Sandza moved that the application be denied because the minor application is untimely and not an immaterial change.  Commissioner Gates seconded this motion.  Vote: 6-1-0 Commissioner Smith opposed.

 

There was a motion to have Commissioner Sandza represent ANC3D at the BZA hearing with Commissioner Gates as backup.  Approved 7-0-0.

 

5.  Minute Clinic-Application for Certificate of Need-

 

Dr. Eric Marshall and Karen Lovitch appeared before the Commission.

Dr. Marshall is a family practitioner with Gerald Family Care, P.C.  Ms. Lovitch is the spokesperson for Minute Clinics.

 

These clinics would be staffed by two nurse practitioners in CVS stores, and they would provide services on a walk in basis for minor ailments such as flu, strep, athletes foot, etc.  Vaccine would be offered.  They said they would refer patients to other medical doctors if the clinic could not treat them.  Commissioner Wells noted that the Minute Clinics do not offer HIV/AIDS testing.  She urged the clinics to be responsive to specific DC health needs and concerns like the DC Public Health campaign to test all DC residents for HIV.  

 

Commissioner Heuer moved to support this application for certificate of need. Commissioner Haas seconded.  Vote: 5-2-0.  Commissioners Wells and Smith opposed.

 

6.      Resolution to protest additional flights into DC National Airport

 

Commissioner Thompson moved to accept this resolution which was also passed by the Palisades Citizens Association.  Commissioner Smith seconded.  Vote: 7-0-0.

 

7.      Resolution to protest closure of Jelleff Boys and Girls Club in Georgetown.

 

Commissioner Sandza moved to accept this resolution.  Commissioner Smith seconded.  Vote 7-0-0.

 

Commission Business

 

Treasurer’s Report:  There is currently a balance of $26,833.71 in the Bank of America checking account.

 

An audit for 2004 through May 2007 was conducted on May 10th by the DC Auditor.  It was very successful and the auditor said he used ANC3D as a benchmark upon which to judge other ANC’s

 

The minutes from the May 2, 2007 meeting were approved 7-0-0 with one correction.

 

The next meeting will be July 11, 2007.
